Welcome to Beacon By Owner ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the website, marketplace platform, products, applications, and services located at beaconbyowner.com (collectively, the "Platform" or "Services"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Marketplace Platform Only

The Platform is a curated online marketplace that connects independent property owners, operators, and hosts ("Hosts") with guests seeking wellness-oriented accommodations ("Guests").

BEACON BY OWNER IS NOT THE OWNER, OPERATOR, MANAGER, INSURER, OR PROVIDER OF ANY PROPERTY, ACCOMMODATION, WELLNESS SERVICE, OR EXPERIENCE LISTED ON THE PLATFORM. Hosts are solely responsible for their properties, compliance with applicable laws, safety standards, licensing, insurance coverage, and all interactions with Guests.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Platform. By using the Platform you represent and warrant that you have legal authority to enter into these Terms, will comply with all applicable laws, and that all information you provide is accurate and truthful.

3. No Medical or Wellness Advice

The Platform may feature properties or amenities associated with wellness, recovery, fitness, relaxation, or related experiences. BEACON BY OWNER DOES NOT PROVIDE MEDICAL ADVICE, HEALTHCARE SERVICES, OR THERAPEUTIC GUARANTEES. Any wellness-related information is provided for informational and lifestyle purposes only. Guests should consult qualified medical professionals before participating in any wellness activities or using any amenities.

4. Assumption of Risk

You acknowledge that travel, lodging, wellness amenities, pools, saunas, cold plunges, fitness equipment, and related activities involve inherent risks. By using the Platform or any listed property, you voluntarily assume all risks associated with your participation and use.

5. Orders, Pricing, and Payment

All bookings and orders are subject to acceptance and availability. We reserve the right to refuse or cancel any booking or order at our discretion, including for suspected fraud or pricing errors. Prices are shown in the listed currency and exclude taxes, duties, and fees unless stated otherwise. Payment must be received in full before a booking or order is confirmed.

Payments may be processed through third-party payment providers including Stripe or other processors. We are not responsible for payment processor errors, delays, chargebacks, banking issues, or unauthorized transactions outside our reasonable control.

6. Shipping, Returns, and Refunds

For physical product purchases, shipping estimates are not guaranteed delivery dates and risk of loss passes to you upon delivery to the carrier. Returns are accepted on unused items in original condition within 30 days of delivery; certain items may be marked final sale. Refunds are issued to the original payment method, less any return shipping costs, within a reasonable period. Booking cancellations and refunds are governed by the cancellation policy associated with the applicable Host listing.

7. Intellectual Property

All Platform content, including text, graphics, logos, images, photographs, branding, designs, and software, is owned by Beacon By Owner or our licensors and is protected by copyright, trademark, and other laws. You may not copy, reproduce, modify, distribute, exploit, or create derivative works from Platform content without our prior written consent.

8. User Conduct and Acceptable Use

You agree not to:

• violate any law or regulation;
• misrepresent your identity or affiliation;
• circumvent Platform payments or fees;
• engage in fraud, harassment, or abusive conduct;
• upload unlawful, infringing, or malicious content;
• interfere with or disrupt the Platform or attempt to gain unauthorized access;
• use automated means to scrape or harvest data from the Platform; or
• infringe the rights of others.

We reserve the right to suspend or terminate accounts at our discretion for any violation of these Terms.

9. User Content

If you submit reviews, listings, photos, comments, or other content, you grant Beacon By Owner a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, distribute, and display that content in connection with the Platform. You represent that you have all rights necessary to grant this license.

10. Disclaimers

THE PLATFORM, SERVICES, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY LISTING, HOST, OR GUEST INFORMATION IS ACCURATE OR COMPLETE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BEACON BY OWNER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE PLATFORM. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE TOTAL FEES PAID TO BEACON BY OWNER DURING THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Beacon By Owner and its officers, directors, employees, affiliates, and agents from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your interactions with Hosts or Guests; or (d) any injury, damage, or dispute arising from use of a property or amenity listed on the Platform.

13. Arbitration and Class Action Waiver

Any dispute arising from or relating to these Terms or the Platform shall be resolved exclusively through final and binding arbitration administered in the State of [STATE]. YOU WAIVE THE RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR JURY TRIALS. Nothing in this section prevents either party from seeking injunctive relief in a court of competent jurisdiction to protect intellectual property rights.
